Terms of Service

1. Agreement

By accessing or using any service provided by Hench Marketing ("Hench Marketing", "we", "us"), including PERSONA and Hey Susan, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Services

Hench Marketing provides creator analytics dashboards, social media management tools, and related software services. Our services connect to third-party platforms (X/Twitter, YouTube, TikTok, Instagram, Twitch) via their official APIs to display analytics and performance data.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these terms. By using our services, you represent that you meet these requirements. Our services are intended for professional use by content creators, social media managers, and marketing professionals.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at legal@henchmarketing.online if you suspect unauthorised access.

5. Platform Authorisation

To use our analytics features, you must authorise our application to access your social media accounts via OAuth. By connecting your accounts, you grant us permission to access and store analytics data as described in our Privacy Policy. You can revoke this access at any time. Revocation will disable relevant features but will not delete your account.

6. Acceptable Use

You agree not to:

• —Attempt to gain unauthorised access to our systems or other users' accounts
• —Use our services in a way that violates the terms of any connected platform (X, YouTube, TikTok, Instagram, Twitch)
• —Reverse engineer, decompile, or attempt to extract source code from our services
• —Resell, sublicense, or commercially redistribute our services without written authorisation

7. Data & Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these terms by reference. We handle your data as described therein.

8. Third-Party Platforms

Our services rely on third-party platform APIs. We are not responsible for changes to those APIs, platform outages, or data unavailability caused by third parties. Your continued use of connected platforms is subject to those platforms' own terms of service.

9. Service Availability

We aim to keep our services available and reliable, but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications at any time. We will attempt to provide advance notice for significant downtime.

10. Intellectual Property

All software, designs, and content produced by Hench Marketing are our intellectual property. Your analytics data remains yours. We claim no ownership over content you create or publish on connected platforms.

11. Limitation of Liability

To the maximum extent permitted by law, Hench Marketing shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount you have paid us in the 12 months prior to the claim.

12. Termination

Either party may terminate these terms at any time. We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, you may request deletion of your data as described in our Privacy Policy.

13. Governing Law

These terms are governed by the laws of the jurisdiction in which Hench Marketing operates. Any disputes shall be resolved in the courts of that jurisdiction.

14. Changes to These Terms

We may update these terms at any time. Continued use of our services after changes constitutes acceptance. We will notify you of material changes via email.
